Judge allows WSU football player Robert Barber back on the field and in the classroom

COLFAX, Wash. -

In a hearing Wednesday morning in Colfax, Whitman County Judge David Frazier granted a motion to grant an immediate stay of Washington State University's suspension of nose tackle Robert Barber. The say allows Barber back on the football field under the condition that he not attempt to contact the student who he injured at a house party in July, use drugs or attend parties where drugs and alcohol are present. 

Barber's, attorney Steve Graham, argued that Barber should be allowed to play because it would cause him irreparable harm to not do so, and that Barber’s petition to have his full case reviewed in court would prevail if it were to be heard.

Danielle Hess, the chief of the WSU division of the state attorney general's office, made the case for the university and argued that Barber did not raise an issue about the student conduct board failing to ask certain questions during the appeal process, which she says deprived the university the chance to respond. 

WSU's case rested largely on the fact Barber admitted to punching the student back in July a second time after an initial punch knocked him to the ground, and that Barber could not have felt threatened once the student was on the ground.

WSU Athletic Director Bill Moos issued a statement on the situation,

“We certainly respect today’s decision by the Whitman County Superior Court,” said Moos. “With Robert being reinstated as a student in good standing, he will be afforded all the privileges as his fellow students, including the opportunity to complete his degree and participate with the Cougar football team. As for his playing status, that will be determined by Coach Leach. As there is still a legal matter pending, I will have no further comment on this situation.”

After the ruling, Barber told KHQ he will be back in class on Thursday and back to practice soon.
